Q: Have a listing agreement and now my renter wants to buy my home. Place has not yet been listed, no marketing, etc. Would I owe any fees to the agent and how should I handle this?

A: Dear Texas Seller, I don?t see how you would owe any agent a commission if your property is not listed and you are leasing on your own. You might want to have the help of a good realtor for the purchase contracts and liability for the sale though, and in that case you will owe a commission for their time. You could also use a Real Estate Attorney, to complete the sale.

A: Bring your paperwork and situation to a local real estate attorney and pay them to review it for you. Realtors aren?t allowed to interpret the meaning/ramifications of legal contracts? that requires a license to practice law. Best of luck!

A: This occurs quite often after a home has been listed with a realtor and either a friend, relative or renter wants to purchase the home. Have you signed the listing contract to have an agent put your home on the market?? Next you need to look over the contract you have signed and talk with your agent. Some agents will work with you on the listing commission but it is actually up to the agent?s broker to determine the commission charged. Some brokers immediately advertise, put up signs, etc ? so you need to talk with your agent and their broker.
